Step by step

What to do after an accident

The first days are confusing. This is the same list we walk through with people on the phone. Tick things off as you go; nothing you tick leaves this page.

If anyone is hurt, call 911 first. Everything else on this list can wait until people are safe.

Cases we take

Injury cases only, so it’s the work we do every day. If yours isn’t something we handle, we’ll say so on the first call and tell you who does.

  • Car crashes

Rear-end, intersection and highway collisions, including hit-and-run and uninsured drivers.

    What we look at

The police report, photos, both insurance policies, your own coverage for uninsured drivers, and what the injury has cost you in work and day-to-day life.

  • Truck crashes

Collisions with 18-wheelers, delivery vans and work trucks, where more than one company may be involved.

    What we look at

Who owned the truck, who employed the driver, and who loaded it. We send letters early asking each company to keep its logs and recordings.

  • Motorcycle crashes

Riders hit by drivers who “didn’t see them,” and the unfair assumptions riders face afterward.

    What we look at

Sight lines, the scene, the bike itself, and witnesses. We keep the bike as it is until it has been photographed and inspected.

  • Pedestrians and cyclists

People struck in crosswalks, parking lots and bike lanes, often with serious injuries.

    What we look at

Signals, crosswalk timing, nearby cameras, and your own auto policy, which may cover you even though you weren’t driving.

  • Rideshare and delivery

Passengers, drivers and people hit by a rideshare or delivery driver while they were working.

    What we look at

Whether the app was on, whether a ride was accepted, and which of several insurance policies applies at that moment.

  • Slips, trips and falls

Falls on wet floors, broken stairs and unlit walkways at stores, apartments and other properties.

    What we look at

What the owner knew, how long the hazard was there, and any cameras. Stores often keep footage only a short while, so call early.

  • Dog bites

Bites and knock-downs, for children and adults, usually covered by the owner’s home or renter’s insurance.

    What we look at

Who owned or was keeping the dog, any earlier reports, and the owner’s insurance. Photos of the injury as it heals help a great deal.

  • Injuries at work

On-the-job injuries, including when someone other than your employer caused them.

    What we look at

Whether your employer carries workers’ compensation, and whether a contractor, a property owner or a driver also shares responsibility.

  • Wrongful death

When a family loses someone to another person’s carelessness. We go at your pace, and we come to you.

    What we look at

Who can bring the claim under Texas law, the estate’s needs, and the time limits, explained gently and in writing.

How our fee works

No attorney’s fee unless we recover. Here’s exactly what that means.

This is called a contingency fee. It’s how most injury lawyers work, and the terms are worth reading slowly. Ours are below, in plain words, and in the written agreement you take home before you decide.

Our fee is a share of any recovery

33⅓% of the amount recovered

Most cases resolve with the insurer before anyone files a lawsuit. If yours does, this is our share.

Nothing up front

You pay no retainer and no hourly bill. The consultation is free, and so is asking us to look over the case before you decide.

Case costs, explained

Things like records, filing fees and expert reports. We pay them as the case goes, and they’re repaid from the recovery. Your agreement says whether our percentage is figured before or after they’re repaid.

If there’s no recovery

You owe us no attorney’s fee, and we don’t ask you to repay the case costs we advanced. Your own medical bills are still owed to your doctors, and we help you deal with them.

When a case resolves, the money goes in this order

  1. 1The settlement check is paid into our firm’s trust account, never our own.
  2. 2Our fee and case costs, as your written agreement sets out.
  3. 3Medical bills and liens we’ve negotiated on your behalf, where the law allows.
  4. 4The rest goes to you. You see and sign an itemized statement first.

Fee terms are set by the written contingency agreement you sign, which governs if anything here differs. Every case is different, and no lawyer can promise a result or a recovery.

From the first call

How a case usually goes

No two are the same, and we can’t tell you how long yours will take until we know more. This is the usual shape, and where you’ll hear from us.

  1. 01

    A free consultation

About thirty minutes, by phone, video or in person. You tell us what happened; we tell you honestly whether we can help.

You decide whether to hire us. No pressure, no paperwork that day.

  2. 02

    We gather the facts

Reports, photos, witness statements and insurance policies. We tell the insurers to contact us, not you.

You focus on getting better. We take the calls.

  3. 03

    Treatment comes first

We wait until your doctors have a clear picture, so nothing is settled before anyone knows the full cost.

An update from us every two weeks, even when it’s quiet.

  4. 04

    The claim and negotiation

We send the insurer a full account of your claim, then negotiate. Every offer comes to you with our advice.

You decide whether to accept. Always.

  5. 05

    A lawsuit, only if needed

If talks stall, we may recommend filing. We explain what that means for time, cost and our fee before you agree.

Filing doesn’t mean a trial. Many cases still settle.

Questions people ask us first

General information, not legal advice for your situation. For that, the consultation is free.

Ask us yours
How much is my case worth?

Honestly, nobody can tell you that on the first call, and you should be careful of anyone who does. It depends on the injury, the treatment still ahead, the insurance available and the facts about fault. What we can tell you early is whether you have a claim worth pursuing, and what we’d need to find out.

The other driver’s insurer called me. Should I talk to them?

You can be polite and take their name and number. You don’t have to give a recorded statement or sign anything, and it’s fine to say you’ll call back after you’ve spoken to a lawyer. If you hire us, they talk to us instead.

What if the accident was partly my fault?

You may still have a claim. In Texas, a person who is partly at fault can often still recover, reduced by their share of the fault, as long as it isn’t more than half. We’ll talk through the facts with you.

How long do I have to do something?

There are legal deadlines, and some, like notices for claims against a city or county, can be very short. Evidence like store camera footage can disappear in days. If you’re unsure, call; we’ll tell you the deadlines that apply to you.

Will I have to go to court?

Most of our cases are resolved without a trial. If a lawsuit is ever recommended, we explain why and what it involves, and you decide. If your case does go to trial, we prepare you for every step.

I can’t afford a lawyer. Can I still call?

Yes. The consultation is free, there’s nothing to pay up front, and our fee comes only from a recovery, as explained in how our fee works.
