Family law in Ashwell, Massachusetts

Family changes are hard. The way through can be gentle.

Divorce, custody, mediation and adoption, handled by three attorneys who listen first. We help families reach agreements they can live with, and we stand steady beside you in court when that’s what it takes.

Private from the first message. We only call or email in the ways you tell us are safe.

A gentle guide

Where to start

Most people who call us aren’t sure what they need yet. Choose whatever is closest to where you are today, and we’ll show you what usually comes first.

What’s on your mind?

You don’t have to decide anything yet.

Many people talk to us months before anything changes, just to understand their options. That conversation is confidential, and it commits you to nothing.

  1. Learn where you stand. What would happen to the house, savings and retirement accounts, and how parenting time usually works.
  2. Gather what you can, quietly. Recent tax returns, pay stubs and account statements, if you can reach them safely.
  3. Think about support. A counselor for you, and for the children if they’re struggling. We can suggest people.

Usually a first conversation with Miriam or Clara.

How we help

Family law, and only family law

Flat fees wherever the work allows, quoted in writing before we begin. Where a matter can’t be predicted, we bill hourly, estimate in advance and tell you before we pass the estimate.

  • Divorce

Uncontested and contested divorce, dividing property and retirement accounts fairly, and alimony when it applies.

Uncontested from $2,800 · contested, hourly with an estimate

  • Custody and parenting plans

Parenting schedules that work on school nights, decision-making, relocation and holidays, written around your children.

Parenting plan from $1,600 · court matters, hourly

  • Mediation

A neutral mediator helps you both reach your own agreement, privately and usually faster and at lower cost than court.

$420 per two-hour session, usually shared

  • Adoption

Stepparent, relative, second-parent and agency adoptions, from the first consent form to a hearing your family will remember.

    Stepparent adoption from $2,400

  • Child and spousal support

Support calculated under the state guidelines, explained so you can check every number, and enforced when payments stop.

    Hourly, with a written estimate

  • Prenuptial agreements

Clear, fair agreements before (or after) a marriage, so a hard conversation happens once, kindly, and is done.

From $1,900 for one spouse’s side

Fees shown are our attorney’s fees and exclude court filing fees and outside costs. Your fee is confirmed in a written engagement letter before any work begins.

Ways through

Three ways to reach an agreement

Not every family needs a courtroom, and not every family can avoid one. We practice all three, so we can recommend the one that fits rather than the one we happen to do.

Often a good fit when you can still talk to each other, even if it’s hard, and there are no safety concerns.

Children and two homes

Two homes, one childhood

A good parenting plan is less about winning time and more about a week your children can count on. These are the things we help parents settle, so they don’t have to be argued about later.

  • A weekly rhythm that fits school, work and the drive between homes
  • Holidays, birthdays and summers, planned a year ahead
  • How you’ll make decisions about school and health care
  • How you’ll talk to each other, and how the children reach each of you
  • What happens if one of you wants to move

We’re happy to suggest family counselors and books for children of different ages. Just ask.

Your first consultation

What the first hour is like

An unhurried hour, in the garden room or by video. Bring questions, not answers.

$150

for up to an hour. If you go on to work with us, it comes off your first bill.

  1. A quick conflict check

Before we meet, we check that we’ve never worked for the other person. That’s why the form asks for their name.

  2. Your story, at your pace

Tell us what’s happening and what you hope for. Tissues are on the table, and stopping for a breath is fine.

  3. Your options, plainly

What the law says about your situation, the paths open to you, and what each usually involves.

  4. A written next step

Within two business days, a short letter with what we discussed and, if you’d like, a fee quote. No pressure to decide.

Questions

What people often ask

General information about Massachusetts family law, not advice for your situation.

Can one lawyer represent both of us?

No. An attorney can only represent one spouse or parent. A mediator, though, can work with both of you together without taking sides, and each of you can have your own attorney review the agreement.

How long does a divorce take?

An uncontested divorce, where you agree on everything, is often a few months from filing to final. A contested divorce can take a year or more. We’ll give you an honest estimate once we know your situation.

Will we have to go to court?

Even an agreed divorce usually involves one short hearing, where a judge reviews your agreement. Many families never need more than that. If yours does, we prepare you for every step.

How is custody decided?

By what is in the children’s best interests. Courts look at things like each parent’s role so far, stability, the children’s needs and, sometimes, their wishes. When parents agree on a plan, the court usually approves it.

What if I’m worried about my safety?

If you are in danger now, call 911. Tell us when you reach out that safety is a concern, and we’ll talk about protective orders and how to contact you safely. The Quick exit button at the top of this site leaves it at once.

What will it cost?

Many matters have a flat fee, shown under how we help. Contested matters are billed hourly, with a written estimate and a call from us before we pass it. You’ll always know the basis before any work begins.
